Desco Europe Terms & Conditions - USD

PRICING: The prices on the Desco Europe website supersede all previous prices and may change without notice. Online orders qualify for Internet Pricing and Online Promotions. Hard-copy orders may be placed at "Regular Price" as shown on our web site. All prices are in US Dollars (USD), exclusive of VAT and carriage, and are subject to the following terms:

ORDERING OPTIONS: You may order online or submit a hard-copy Purchase Order:

1. Online Ordering:
The most accurate and fastest method to process your order is to place it online through our web site. The benefits of ordering online include:

  • No minimum order amount for online orders
  • You receive Internet pricing. This price only applies to standard items.
  • Your order is expedited directly to shipping - No delays because of discrepancies. Online orders are prioritized and will be processed first. (On average on-line orders are processed and shipped 1 business day faster than paper orders)
  • Error Free - You place your order correctly the first time - no keying errors on our side.
  • Use a Purchase Order Number or Credit Card.
  • Order can be shipped Prepay & Add or Collect.
  • Order using real-time pricing and availability on any item - anytime.
  • Check order status online and access your order history and invoices.

2. Hard Copy Orders:
If you are not able to place your order online, we will accept your hard-copy Purchase Order via EMAIL at Service@DescoEurope.com

MINIMUM ORDER: There is no minimum order for online orders. The minimum order value for offline orders is $200. Orders under $200 must be processed online at www.descoeurope.com.

SHIPPING AND HANDLING CHARGES: Shipments are Ex Works (EXW Incoterms 2010) our dispatch location. Shipments are not insured, but may be insured at the Customer’s option and cost. Please let us know in writing at time of order if you wish your shipment insured. Goods are normally shipped by the customer's nominated carrier. Desco Europe may provide the option to ship by our carrier. In this case, any freight charges quoted (by the website or our customer services team) are estimated; they do not necessarily represent the carrier's published rates and may include additional charges levied by the merchant. Freight charges for credit card orders are paid in advance. Freight charges for open accounts are prepaid and added to the invoice per shipment.

CUSTOMER COLLECTION: It is possible to have orders prepared for Pick-Up by the customer or their carrier. This option must be pre-arranged with Customer Service. Once the customer is notified that their order is complete, it must be collected from our factory within 72 hours. After 72 hours the items will be returned to stock minus a 20% re-stocking fee ($40 minimum).

NORMAL DELIVERY: Most orders ship from the factory within 3 working days.

PARTIAL SHIPMENTS: Partial shipments will be made unless the order specifies that the order is to ship complete.

CANCELLED ORDERS: All orders placed with Desco Europe are considered final once confirmed. Requests to cancel orders to Desco Europe must be made in writing. A request for cancellation and the reason for cancellation can be sent to Orders@DescoEurope.com. No cancellation will be honoured without an emailed response from Desco Europe. Orders invoiced prior to a cancellation request will be subject to the terms for returned merchandise.

BUILD-TO-ORDER (BTO) ITEMS: BTO items are normally not in stock and are available on a per-order basis only. Check our website or contact customer service for applicable minimum quantity and lead time. Actual quantity shipped and invoiced may be +/-10%. Some inventory may be in stock. Build-to-Order Items are covered by Limited Warranty for defects in material and labor only. Orders for BTO items cannot be cancelled or returned.

SPECIAL MANUFACTURED ITEMS: Special manufactured items are available on a per-order basis only. Contact customer service for applicable minimum quantity and order amount. First article approval is required. Actual quantity shipped and invoiced may be +/- 10%. Special manufactured items are not returnable for credit.

INSURING YOUR SHIPMENT: You are responsible for your shipment once it leaves our factory. The cost to insure a Business Post shipment is minimal. Call or eMail customer service for more information. The buyer is responsible for uninsured lost or damaged shipments.

SHORT SHIPMENT & PRICING CLAIMS: All claims pertaining to invoices (including short shipments, pricing discrepancies, freight charges, etc.) must be made in writing within 7 days of the invoice date. Claims must include copy of original PO, PO number, invoice number, and invoice date. All claims must be approved by Desco Europe.

DAMAGE CLAIMS: Desco Europe will not issue credit, or take responsibility for merchandise lost or damaged by the carrier. In accordance with Ex Works (EXW) freight terms, the customer holds title to the goods once Desco Europe has made them available to the customer or the customer's carrier. Therefore the customer is responsible for settling all damage or loss claims with carriers. Desco Europe will assist customers in any reasonable manner to establish damage claims with common carriers.

FORCE MAJEURE: Desco Industries shall not be liable for any delay in delivery or for non-delivery, in whole or in part, caused by the occurrence of any event beyond the reasonable control of Desco Industries. If such event occurs, Desco Industries may allocate production and deliveries among its customers.

PAYMENT TERMS: Desco Europe’s payment terms are either Credit Card, or Net 30 days by wire transfer. A credit check may be required by Desco Europe before Net 30 terms are given. Credit card pre-payments are taken at point of order.

Credit cards are charged in USD - credit cards in other currencies may incur fees from your card issuer, for which you will be liable. Credit card payments accepted after date of invoice are subject to a 5% service charge. Also note that there is a $500 minimum on pre-payments by bank transfer. Orders below this value need to be paid by credit card.

Please note that we bear only our own bank’s charges. We will not bear the payee’s charges nor those of intermediary banks.

CREDIT HOLD : New orders will not be accepted or entered into the queue if any invoices are past due. Promised deliveries for existing orders will be moved to the end of the queue if any invoices become past due. Past due amounts may be subject to late fees and/or additional service charges may be applied at DII's discretion.

STATEMENTS: Please note that we do not issue statements; you are asked to pay against invoice. Invoices are available to view via the online site at no charge.

CERTIFICATE OF CONFORMITY: A ‘Certificate of Conformity’ can be obtained at no charge by going to the My Account section of the web site. For electronics items that are calibrated, a Calibration Certificate will be included with the item at no charge.

RESTRICTION OF THE USE OF CERTAIN HAZARDOUS SUBSTANCES (RoHS): Directive 2002/95/EC of the European Parliament aims to regulate and reduce the content of mercury, cadmium, lead , chromium VI, fire retardants PBB and PBDE in electrical and electronic equipment. Most Desco Europe products comply with the Directive; those that do not comply are exempt per Category 9 (Monitoring and Control Instruments). SIZES: All linear dimensions are approximate. They can be expected to vary only to the extent within which they remain fit for general use. They have been measured using commercially available non-calibrated tape measures.

RETURNED MERCHANDISE: All returns to Desco Europe must be approved in advance. If you want to return a purchased item for any reason, just contact customer service and receive a Return Material Authorization (RMA) number (Returned Merchandise charges may apply). This number must appear on the outside of returned cartons and paperwork. Desco Europe reserves the right to refuse all returned shipments which do not bear the RMA number or which are returned at our cost. Return the product along with proof of purchase. Returned items must be defect-free and in a re-sellable condition and be returned within 30 days of purchase. No product can be returned or credit issued for products after 30 days of purchase. A credit will be issued that can be used towards the purchase of any Desco Europe item. 20% will be deducted as a restocking charge ($20 minimum) and automatically deducted from each RMA credit. The restock charge will not apply to defective or demo merchandise or errors caused by Desco Europe.

Note: Garments, floor coatings, and opened media items such as CD’s and DVD’s are non-returnable unless defective.

VAT: We will add VAT to all UK invoices at the rate applicable on the date of the invoice. Our VAT number is GB356653824.

GUARANTEE: We guarantee our products are of the highest quality and meet all appropriate industry standards. Desco Europe wants you to be confident with each product we produce. We make every effort to see to it that our products are of the highest quality and meet all appropriate recognized industry standards. Since we cannot guarantee that all products are applicable to all situations and that the data we provide from many sources is reliable and accurate for all situations, our lawyers want you to know that... All statements, technical data, and recommendations contained herein are based upon tests we believe to be reliable. However, the accuracy or completeness thereof is not guaranteed. The proper and correct application of products and data is the responsibility of the user. The following is made in lieu of all warranties, expressed or implied:
Desco Europe's only obligation shall be to replace such quantity of the product proved to be defective. Desco Europe shall not be liable for any injury, loss, or damage, direct or consequential, arising out of the use of or the inability to use the product. Before using, users shall determine the suitability of the product for their intended use, and users assume all risk and liability whatsoever in connection therewith. No statement or recommendation not contained herein shall have any force or effect unless embodied in a written agreement signed by authorized officers of Desco Europe.
